Moodify Terms of Use

Welcome to Moodify! These Terms of Use ("Terms") govern your access to and use of Moodify's photo editing application ("Moodify" or "the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By using the App, you agree to comply with and be bound by these Terms and any amendments thereto. Moodify reserves the right to update or change these Terms at any time. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

2. User Accounts

A. Registration: You may be required to create an account to use certain features of the App. You must provide accurate and complete information during registration and keep your account information updated.

B. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Moodify immediately of any unauthorized use of your account.

3. License

Moodify grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license is subject to your compliance with these Terms.

4. User Conduct

You agree not to use the App to:

• A. Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.

• B. Violate any local, state, national, or international law.

• C. Infringe upon the intellectual property rights of others.

• D. Transmit viruses, malware, or other harmful code.

5. Content Ownership and Usage

A. Your Content: You retain all rights to any images, photos, or other content you upload to the App ("Your Content"). By uploading Your Content, you grant Moodify a worldwide, non-exclusive, royalty-free license to use, display, and distribute Your Content for the purpose of operating and improving the App.

B. Moodify's Content: All content provided by Moodify, including but not limited to text, graphics, logos, and software, is the property of Moodify or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any Moodify content without prior written permission.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Termination

Moodify reserves the right to terminate or suspend your account and access to the App at any time, without notice, for conduct that Moodify believes violates these Terms or is otherwise harmful to other users or the App.

8. Disclaimers

A. No Warranties: The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

B. Limitation of Liability: Moodify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, or the like that may be transmitted to or through the App by any third party.

9. Indemnification

You agree to indemnify and hold harmless Moodify and its affiliates, officers, agents, employees, and partners from any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of your use of the App or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, Chicago, IL, without regard to its conflict of law principles.
